Resumen
O artigo analisa, do ponto de vista legal e constitucional, os desígnios do movimento ?Escola Sem Partido? por meio de uma pesquisa doutrinária profunda sobre a finalidade constitucional da educação no Brasil e também sob a perspectiva de julgados do Supremo Tribunal Federal (STF) e dos Tratados Internacionais. Este estudo é feito através de pesquisa bibliográfica profunda e exame de julgados e visa a ressaltar a inconstitucionalidade dos instrumentos normativos que derivam do movimento ?Escola Sem Partido?, em relação ao propósito do movimento e nos termos já analisados pelo STF, com destaque para os princípios e garantias constitucionais violados, especialmente aqueles que devem alcançar o exercício de cátedra e a garantia plena de acesso à educação.O artigo, ademais, justifica a conclusão pela inconstitucionalidade dos instrumentos derivados do movimento, com a devida indicação das violações, que se mostram incompatíveis com a garantia de uma sociedade democrática.Palavras-chave: Educação. Ideologia.THE UNCONSTITUCIONALITY OF SCHOOL ?WITHOUT PARTY MOVEMENT?AbstractThe article analyzes, from a legal and constitutional point of view, the aims of the ?School Without Party? movement through a profound doctrinal research on the constitutional purpose of education in Brazil and also from the perspective of the Federal Supreme Court (STF) and International Treaties. This study is done through deep bibliographic research and judging and aims to highlight the unconstitutionality of the normative instruments that derive from the movement ?School Without Party?, in relation to the purpose of the movement and under the terms already analyzed by the STF, with emphasis on the violated constitutional principles and guarantees, especially those that should achieve the exercise of the chair and the full guarantee of access to education. The article, moreover, justifies the conclusion by the unconstitutionality of the instrumentsderived from the movement, with the due indication of violations, which are incompatible with the guarantee of a democraticsociety.Keywords: Education.
